Civilizations rely not on power alone but also on shared rules and institutions that can support trust, stability, and cooperation across generations.
Why Can Civilization Not Rely on Power Alone?
Large societies require ways to coordinate behavior, settle disputes, allocate responsibilities, and respond to violations. These functions can be carried out through custom, reputation, religious obligation, community deliberation, political authority, and formal law. Civilization has never depended on only one source of order.
Rulers have often used military force, taxation, administration, ritual authority, and law together. Power can compel compliance, while institutions can make expectations more stable and public. The two should not be treated as simple opposites, because law can restrain power but can also authorize and extend it.
Political leaders die and governments change, yet some institutions survive those transitions. Courts, councils, offices, religious bodies, local customs, and administrative records may preserve continuity. In other cases, institutions collapse with a regime. Historical outcomes depend on how authority is distributed and how deeply practices are embedded.
Law did not emerge everywhere as an impersonal alternative to personal rule. Early law collections were often issued or sponsored by rulers and linked justice with royal authority. Customary practices, judicial decisions, contracts, decrees, and written collections coexisted in different combinations.
What later came to be called the rule of law makes a more specific demand. Public power should be exercised through known and relatively stable norms rather than through arbitrary decisions, and officials should themselves be subject to legal constraints. The existence of written rules alone does not satisfy this requirement.
Power can secure temporary compliance, but durable institutions may allow obligations, offices, and procedures to continue beyond a particular ruler. Whether they also produce justice or trust depends on their content, enforcement, accessibility, and treatment of different groups.
Why Can Shared Rules Support Stable Societies?
People make plans partly by forming expectations about how others and institutions will act. Merchants may exchange goods when contracts, reputation, and enforcement make performance sufficiently predictable. Families may plan inheritance when relevant claims and procedures are recognized. Communities may cooperate when rules are understood and regarded as workable.
Formal law is only one component of these expectations. Informal norms, professional standards, religious duties, kinship, reputation, and repeated interaction can also structure behavior. Douglass North therefore described institutions as including both formal rules and informal constraints.
Rules can enable cooperation among people who lack close personal relationships. They may reduce the need to negotiate every interaction from the beginning. This does not mean that strangers automatically trust one another because a law exists. Impartial enforcement, procedural fairness, access to remedies, and confidence in institutions also matter.
Elinor Ostrom’s research on common resources showed that communities can develop durable rules for cooperation without relying solely on centralized command or private ownership. Effective arrangements varied according to local conditions and included monitoring, graduated sanctions, and participation in rule-making. There is no single institutional design suitable for every society.
Rules also transmit categories of rights, duties, offices, and procedures across generations. Later generations inherit constitutions, statutes, precedents, customs, and administrative practices, but they interpret, contest, and modify them. Legal continuity is therefore maintained through practice rather than through unchanged words alone.
Stable societies are not built merely by obedience. Their institutions also depend on people who interpret rules, challenge violations, provide public services, resolve disputes, and demand reform. Compliance and criticism can both contribute to legal continuity.
Why Has Law Changed Throughout History?
Legal systems change because political authority, economic relations, technology, social movements, moral arguments, and patterns of conflict change. Alteration may occur through legislation, judicial interpretation, administrative practice, constitutional revision, treaty, revolution, conquest, or resistance.
Law does not simply adapt by itself. Competing groups struggle over which harms should be recognized, whose interests should receive protection, and who may participate in making and applying rules. Legal change is therefore both institutional and political.
The abolition of slavery cannot be described only as law responding to a new moral idea. Enslaved people’s resistance, abolitionist organization, religious and political argument, economic interests, revolution, war, and state action contributed differently across societies. Legal abolition was a decisive outcome, but it did not immediately eliminate coercive labor, racial hierarchy, or their consequences.
The development of human rights and democratic participation also involved movements that challenged existing law. Rights claims were formulated through political struggle and then incorporated, with uneven effectiveness, into constitutions, statutes, judicial decisions, and international agreements.
Law can preserve injustice as well as correct it. Slavery, racial segregation, exclusion from voting, and unequal legal status were sustained through law in many societies. The stability produced by a legal system must therefore be distinguished from its justice.
Continuity and change create a genuine tension. Rules that change unpredictably can make planning difficult, while rules protected from criticism can preserve domination. Legal systems need procedures that permit revision while limiting arbitrary action, but the proper balance remains contested.
Law is not a living organism that grows on its own. It is an evolving body of texts, institutions, interpretations, and practices shaped by people acting under unequal conditions of power. Calling it a ‘living structure’ is therefore a metaphor for continuing interpretation and revision.
Can Artificial Intelligence Govern by Rules?
Different kinds of artificial intelligence must be distinguished. A rule-based program can apply explicitly encoded conditions consistently within a defined system. Machine-learning and generative systems infer patterns from data and may produce outputs that are probabilistic, opaque, inconsistent, or factually incorrect.
Artificial intelligence can assist with document search, classification, comparison, drafting, translation, and the detection of inconsistencies. These uses may increase speed and access. Their reliability depends on the task, system design, source data, evaluation, and human oversight.
Legal applications carry particular risks because laws vary by jurisdiction and change over time, while legal consequences can affect liberty, property, status, and access to public benefits. Research on public language models has documented fabricated cases, incorrect holdings, and uneven performance across courts and periods. Outputs must therefore be verified against authoritative legal sources.
Law is not only a collection of rules to be mechanically matched with facts. Legal reasoning may require determining which facts are relevant, interpreting ambiguous language, weighing precedents, applying standards, and giving affected people an opportunity to contest a decision.
Artificial intelligence can propose policy options and estimate possible consequences. It cannot acquire legitimate law-making authority merely by producing a technically optimized answer. Decisions about rights, duties, acceptable risk, and distribution of burdens require publicly accountable institutions and procedures.
Human judgment is not automatically fair or accurate, and human oversight alone does not solve every problem. Oversight must have relevant expertise, access to the system’s evidence and limitations, authority to intervene, and responsibility for the outcome.
Artificial intelligence may help legal institutions search and administer rules, but it should not be treated as an independent source of justice. Justice depends on substantive values, legitimate authority, fair procedures, evidence, and the ability to challenge error.
The enduring strength of law does not lie in existing separately from power. It lies in the possibility of organizing and constraining power through institutions that can survive particular officeholders while remaining open to public criticism and lawful change.

문명은 권력에만 의존하지 않으며, 여러 세대에 걸쳐 신뢰와 안정 및 협력을 뒷받침할 수 있는 공유 규칙과 제도에도 의존합니다.
문명은 왜 권력에만 의존할 수 없을까?
대규모 사회에는 행동을 조정하고 분쟁을 해결하며 책임을 배분하고 위반에 대응하는 방식이 필요합니다. 이러한 기능은 관습과 평판, 종교적 의무, 공동체의 숙의, 정치 권력, 공식적인 법을 통해 수행될 수 있습니다. 문명은 하나의 질서 원천에만 의존한 적이 없습니다.
통치자는 군사력과 조세, 행정, 의례적 권위, 법을 함께 사용해 왔습니다. 권력은 복종을 강제할 수 있고, 제도는 기대를 더 안정적이고 공개적인 것으로 만들 수 있습니다. 법은 권력을 제한할 수 있지만 권력을 승인하고 확대할 수도 있으므로 두 개념을 단순한 반대로 다루어서는 안 됩니다.
정치 지도자는 죽고 정부는 바뀌지만, 일부 제도는 이러한 전환 이후에도 존속합니다. 법원과 평의회, 관직, 종교 기관, 지역 관습, 행정 기록은 연속성을 보존할 수 있습니다. 반대로 정권과 함께 제도가 붕괴하는 경우도 있습니다. 역사적 결과는 권위가 어떻게 분배되고 관행이 얼마나 깊이 정착했는지에 따라 달라집니다.
법이 모든 지역에서 개인 통치의 비인격적 대안으로 출현한 것은 아닙니다. 초기의 법 모음은 통치자가 반포하거나 후원하는 경우가 많았으며, 정의를 왕권과 연결했습니다. 관습과 재판, 계약, 칙령, 성문화된 법 모음은 사회마다 서로 다른 조합으로 공존했습니다.
후대에 법치주의라고 불리게 된 원리는 더 구체적인 요구를 제시합니다. 공권력은 자의적 결정이 아니라 공개되고 비교적 안정적인 규범을 통해 행사되어야 하며, 공직자 자신도 법적 제약을 받아야 합니다. 성문 규칙이 존재한다는 사실만으로 이 요구가 충족되지는 않습니다.
권력은 일시적인 복종을 확보할 수 있지만, 지속적인 제도는 특정 통치자가 사라진 뒤에도 의무와 관직 및 절차가 이어지게 할 수 있습니다. 그 제도가 정의나 신뢰도 만들어 내는지는 규칙의 내용과 집행, 접근 가능성, 서로 다른 집단을 대하는 방식에 달려 있습니다.
공유 규칙은 왜 안정된 사회를 뒷받침할 수 있을까?
사람들은 다른 사람과 제도가 어떻게 행동할지 예상하면서 계획을 세웁니다. 계약과 평판 및 집행 제도가 이행을 충분히 예측할 수 있게 하면 상인은 상품을 교환할 수 있습니다. 관련 권리와 절차가 인정되면 가족은 상속을 계획할 수 있습니다. 규칙이 이해되고 실제로 작동한다고 여겨질 때 공동체는 협력할 수 있습니다.
공식적인 법은 이러한 기대를 구성하는 요소 가운데 하나일 뿐입니다. 비공식적 규범과 전문직 기준, 종교적 의무, 친족 관계, 평판, 반복적인 상호작용도 행동을 조직할 수 있습니다. 이에 따라 더글러스 노스는 제도에 공식적인 규칙과 비공식적 제약이 모두 포함된다고 설명했습니다.
규칙은 친밀한 개인적 관계가 없는 사람들 사이의 협력을 가능하게 할 수 있습니다. 모든 상호작용을 처음부터 다시 협상할 필요를 줄일 수 있기 때문입니다. 그러나 법이 존재한다는 이유만으로 낯선 사람들이 자동으로 서로를 신뢰하는 것은 아닙니다. 공정한 집행과 절차적 정당성, 구제 절차에 대한 접근, 제도에 대한 신뢰도 중요합니다.
엘리너 오스트롬의 공유자원 연구는 공동체가 중앙집권적 명령이나 사적 소유에만 의존하지 않고 지속적인 협력 규칙을 발전시킬 수 있음을 보여주었습니다. 효과적인 장치는 지역 조건에 따라 달랐으며, 감시와 단계적 제재, 규칙 제정에 대한 참여 등을 포함했습니다. 모든 사회에 적합한 하나의 제도 설계는 존재하지 않습니다.
규칙은 권리와 의무, 관직, 절차의 범주를 여러 세대에 걸쳐 전달하기도 합니다. 후대의 사람들은 헌법과 법률, 판례, 관습, 행정 관행을 물려받지만, 이를 해석하고 논박하고 수정합니다. 그러므로 법적 연속성은 문구가 변하지 않아서가 아니라 실천을 통해 유지됩니다.
안정된 사회는 복종만으로 만들어지지 않습니다. 제도는 규칙을 해석하고, 위반에 이의를 제기하고, 공공서비스를 제공하고, 분쟁을 해결하고, 개혁을 요구하는 사람들에게도 의존합니다. 준수와 비판은 모두 법의 지속성에 기여할 수 있습니다.
법은 왜 역사 속에서 변화해 왔을까?
법률 체계는 정치 권력과 경제관계, 기술, 사회운동, 도덕적 논쟁, 갈등의 형태가 변하기 때문에 변화합니다. 변화는 입법과 사법적 해석, 행정 실무, 헌법 개정, 조약, 혁명, 정복, 저항을 통해 일어날 수 있습니다.
법이 스스로 사회에 적응하는 것은 아닙니다. 서로 경쟁하는 집단은 어떤 피해를 인정할지, 누구의 이익을 보호할지, 누가 규칙을 만들고 적용하는 과정에 참여할지를 두고 다툽니다. 따라서 법의 변화는 제도적 과정이면서 정치적 과정입니다.
노예제 폐지를 법이 새로운 도덕 관념에 반응한 결과만으로 설명할 수 없습니다. 노예의 저항과 폐지운동의 조직, 종교적·정치적 논쟁, 경제적 이해관계, 혁명, 전쟁, 국가의 조치가 사회마다 다르게 작용했습니다. 법적 폐지는 결정적인 결과였지만, 강제노동과 인종적 위계 및 그 후과를 즉시 제거하지는 못했습니다.
인권과 민주적 참여의 발전에도 기존 법률에 도전한 운동이 관여했습니다. 권리에 대한 주장은 정치적 투쟁을 통해 형성된 뒤 헌법과 법률, 사법 판단, 국제 협약에 서로 다른 수준으로 반영되었습니다.
법은 부정의를 바로잡을 수도 있지만 보존할 수도 있습니다. 여러 사회에서 노예제와 인종분리, 투표권 배제, 불평등한 법적 지위가 법을 통해 유지되었습니다. 따라서 법률 체계가 만드는 안정성과 그 체계의 정의로움은 구분해야 합니다.
연속성과 변화 사이에는 실제적인 긴장이 존재합니다. 규칙이 예측할 수 없이 바뀌면 장기적인 계획이 어려워지지만, 비판을 받지 않는 규칙은 지배를 보존할 수 있습니다. 법률 체계에는 자의적인 권력 행사를 제한하면서 개정을 허용하는 절차가 필요하지만, 적절한 균형이 무엇인지는 계속 논쟁의 대상이 됩니다.
법은 스스로 성장하는 생명체가 아닙니다. 법은 불평등한 권력 조건 아래에서 사람들이 만들어 가는 문헌과 제도, 해석, 실천의 변화하는 집합입니다. 따라서 법을 ‘살아 있는 구조’라고 부르는 것은 지속적인 해석과 개정을 뜻하는 비유입니다.
인공지능은 규칙을 통해 통치할 수 있을까?
서로 다른 종류의 인공지능을 구분해야 합니다. 규칙 기반 프로그램은 명시적으로 입력된 조건을 한정된 체계 안에서 일관되게 적용할 수 있습니다. 기계학습과 생성형 시스템은 자료에서 유형을 추론하므로 확률적이거나 불투명하고 일관되지 않거나 사실과 다른 결과를 만들 수 있습니다.
인공지능은 문헌 검색과 분류, 비교, 초안 작성, 번역, 불일치 탐지를 지원할 수 있습니다. 이러한 활용은 속도와 접근성을 높일 수 있습니다. 신뢰성은 과제와 시스템 설계, 원천 자료, 성능 평가, 인간의 감독에 달려 있습니다.
법률은 관할권마다 다르고 시간에 따라 변하며, 법적 결과는 자유와 재산, 지위, 공적 급여의 수급에 영향을 줄 수 있으므로 법률 분야의 인공지능 사용에는 특별한 위험이 따릅니다. 범용 언어모형에 관한 연구에서는 존재하지 않는 판례와 잘못된 판결 요지, 법원과 시기에 따른 불균등한 성능이 확인되었습니다. 따라서 결과를 공인된 법률 자료와 대조해야 합니다.
법은 사실과 기계적으로 대조할 수 있는 규칙의 집합에 그치지 않습니다. 법적 판단에는 어떤 사실이 관련되는지를 판단하고, 모호한 문구를 해석하고, 판례의 중요성을 평가하고, 기준을 적용하고, 영향을 받는 사람에게 결정에 이의를 제기할 기회를 제공하는 일이 포함될 수 있습니다.
인공지능은 정책 대안을 제안하고 가능한 결과를 추정할 수 있습니다. 그러나 기술적으로 최적화된 답변을 생성한다는 이유만으로 정당한 입법 권한을 얻지는 않습니다. 권리와 의무, 허용 가능한 위험, 부담의 분배에 관한 결정에는 공적으로 책임지는 제도와 절차가 필요합니다.
인간의 판단이 자동으로 공정하거나 정확한 것은 아니며, 인간이 감독한다는 사실만으로 모든 문제가 해결되는 것도 아닙니다. 감독자는 관련 전문성을 갖추고 시스템의 증거와 한계에 접근할 수 있어야 하며, 개입할 권한과 결과에 대한 책임을 가져야 합니다.
인공지능은 법률기관이 규칙을 검색하고 집행하는 일을 지원할 수 있지만, 독립적인 정의의 원천으로 취급되어서는 안 됩니다. 정의는 실질적 가치와 정당한 권위, 공정한 절차, 증거, 오류에 이의를 제기할 수 있는 가능성에 달려 있습니다.
법의 지속적인 힘은 권력과 분리되어 존재하는 데 있지 않습니다. 특정한 공직자보다 오래 존속하면서도 공적 비판과 합법적 변화에 열려 있는 제도를 통해 권력을 조직하고 제한할 수 있다는 가능성에 있습니다.
